Marriage Requirements

To be legally wed in New York, you must first apply for a marriage license.  The rules for obtaining a marriage license vary, so it is important to contact your city’s marriage bureau for specific information.  A birth certificate, tax information, and other official documents are required, and you and your partner must apply in person.  There are three components of a license: the first is an affidavit which is an oath of freedom to marry, the second is the actual license, and the third is the Certificate of Marriage.  Non-residents are eligible for license application if they are eligible in their home state.  The license is valid for 60 days.  The fee for a license is $40 to $50 if issued outside of New York City, and #35 if issued in New York City, and includes the fee for a Certificate of Marriage Registration.  There is a 24 hour waiting period after the reception of your marriage license.  If previously married, it is necessary to present proper documentation of divorce or a death certificate.  You must be at least 18 to marry without parental consent.  Blood tests are not required.
